Terms and Conditions of Hire

• We reserve the right to refuse hire items to individuals at our own discretion.
• We reserve the right to immediately terminate hire and retain deposits should these conditions be broken.
• Equipment hired under this Agreement remain the property of Enjoy Oisans at all times.
• Any property left within our garage is left entirely at the owners’ risk.
• Hirers assume liability for any prosecution or insurance claim arising from their actions whilst in the Hire Period.
• Hirers are aware that activities in this area involve certain inherent risks, including inclement weather, rough conditions, navigational difficulties, collisions, hypothermia, illness and accidents in remote places, and might cause them or others injury or loss, or damage their or others property. Despite these risks the hirers accept sole responsibility for their own safety and for the above risks. They will not make any claim against Enjoy Oisans in respect of any injury or loss suffered by them or others; or any damage to any of their or others property regardless of how the injury, loss or damage occurs.
• The use of helmets is not a condition of hire, but we strongly recommend them.
• The hirers agree that Enjoy Oisans is not responsible for any, expense or inconvenience caused by late return of cycles by other hirers or events outside its control.
• If the items are not returned by the expiry of the Hire Period stated at time of booking and by 5PM of that day  the equipment will be deemed to be on hire at the daily rate plus a 50% premium.
• Hirers assume liability for all articles hired on completion of this Agreement. All items when left unattended must be locked to a secure object and this must include all removable items such as the front wheel and frame. Always lock the item when you leave it, you are responsible for the hire item and will be liable for any loss or damage to them.
• A damage deposit of the full amount will be required at the time of hire but this is refundable on return of the hire item on time, clean and undamaged. Check hire item thoroughly before hire. The deposit can be paid in cash or by the provision of credit card details which will be held for the Hire Period, and destroyed upon the return of the equipment in good condition.
• We reserve the right to retain all or part of the deposit should the hire item be brought back in a damaged or unreasonable condition. This does not apply in the case of a fault which is considered to be the result of fair wear and tear.
• All the hire items are maintained by us and are hired to you in a serviced state. If you have any problems with the item, which are a result of mechanical failure and not negligence, we will of course repair the hire item for free. However if you fail to look after the hire item and through the hirer's negligence a fault occurs then a fee will be deducted from your deposit. This is rare and does not normally apply to the majority of our clients. We reserve the right to reclaim monies for damage beyond the cost of the deposit. Furthermore we reserve the right to retain the Hirers property until all outstanding repair invoices are cleared.
• Please notify us immediately after any breakdown, loss and/or damage to the hire items. Any repairs undertaken by you are your responsibility and no reimbursement will be given to you.
• Payment is due at time of booking.
• Please ensure you are happy with the item before you commence the hire period.  Once an item has been taken on hire no refund will be given if you return the item before the end of the hire period.
• Proof of identification is required before the hire can be commenced, for example a National Photo Identity Card, Passport or Driving Licence. The details will be held during the Hire Period.
• Your personal contact details will be stored electronically. If you do not agree with this, please cancel your order now. No credit card/debit card/PayPal details are stored by Enjoy Oisans. Your details will only be used by us, they will not be passed to any third party.

The Hirer agrees as follows:

• To use the equipment in a safe and proper manner.
• To inspected the equipment to be used and find it to be in a good condition and fit for use.
• Is physically fit and there is no health or other reason why they should not Hire under this Agreement.
• Agrees that the laws of the United Kingdom apply.
• Is over 18 years of age or older.
• Has fully read and understood these conditions before agreeing to the hire

In order to hire from us you must indicate that you have read and accept these terms and conditions. If you do not accept them then you are free not to book with us.
